EFFECTIVE COLLABORATIONS WITH SECURITY AGENCIES IS A PANACEA IN CURBING SECURITY THREATS IN THE SOCIETY

This was the focus point of interactions, when members of Edo Civil Society Organisations (EDOCSO) Igueben study centre ably led by the coordinator Leftist Larry Enabulele met with the Police Area Command, Irrua on a familiarization visit.
The police area commander (ACP Benjamin Benafa) joined by other superior officers in the command with two divisional police officers under the command (i.e Dpo Irrua & Ewu) respectively, excluding Igueben were duly on ground to join their boss in giving a warm reception to the visiting human rights practitioners. Discussions were centered on possible ways of bringing a check to the current security challenges including the current spate of kidnapping in the state.

The ACP who promised not to relent in ensuring the good people of the command sleep with two eyes close, however solicited for support and collaborations with the people in nipping the problem on bud.

Ealier, the CSO members thanked the area commander for the show of support and solidarity during her 2023 – End – Of – Year reach-out program.

Highpoint of the visit was the presentation of stationaries as support in our quest of ridding the society of criminally minded individuals.

It is on record that ACP Benjamin Benafa is one of the gallant officers who execute his duties and functions as a police officer with all manners of civility, diligence and respect for human rights.

The CSO however promised to engage the relevant stakeholders and individuals in the society to support the security agencies in terms of operational facilities, as it is practically not possible to fight security challenges with ordinary fingers or crude facilities.

LAW ENFORCEMENT AGENCIES AND EDO STATE GOVERNMENT COLLABORATORS MUST OBEY APPEAL COURT JUDGEMENT ON THE BAN OF MOTORCYCLES

We cannot continue to live like those in a banana republic where the rules of law are not respected or abide to.

Nigeria is guided by laws, which the Edo State Government and other relevant government agencies must know and obeyed.

In recent times, the civil society space have been inundated with series of complaints and petitions from members of the public on the harassment, intimidation, forceful collection of levies and violations of citizens’ rights by Edo State Government, the Nigeria Police Force, the Local government Councils and their agents such as ANNEWATT a private union and other unauthorized bodies all in the name of enforcing the Governor’s order which never existed and thereby arresting and extorting citizens without the money been accounted for

For the purpose of clarity and retrospection, precisely on the 11th of June, 2013 when the former governor of Edo state, Comrade Adams Oshiomhole made an executive fiat on the ban and use of motorcycles from plying all the roads in Oredo, Ikpoba-okha, and Egor local government areas of Benin city and Oluku, Ekosodin villages in Ovia North East Local Government area and Eyaen village (Coca-Cola cola area) in Uhumwonde local government area effective 12 noon 11th of June, 2013 without first passing through legislative processes of making laws.

After the verbal pronouncement of the ban, a lot of motorcycle riders were arrested and prosecuted without fair hearing given to them, thereby violating their fundamental rights, this now made the motorcycle riders, the civil society organisations and other concerned citizens to challenge the order in a court of competent jurisdiction, a legal battle that was Headed by Barr. Dele Uche Igbinedion, after series of court hearing the applicants lost the case and the defendants got judgement in their favour, the applicants were dissatisfied with the judgement which made them approached the appellate court, where they got judgement in their favour in suit No. CA/B/341/2014 and a cost was awarded to them on 25th May, 2021.

Below is the reproduction of the appeal court judgement delivered by Hon Justice Biobele Abraham Georgewill as the lead president

Appeal No. CA/B/341/2014

In its stead, judgement is hereby entered partly In favour of the 1st appellant as 1st applicant against the 1st respondent only in suit No. FHC/B/CS/89/2013 Mr Charles Apiloko James James & Anor V. The Governor of Edo state & ors, and it is hereby declared and ordered as follows, namely

A. It is declared that the 1st respondents action on Tuesday 11/6/2013 of verbally announcing a ban on the use of motor cycles from plying all the roads in Oredo, Ikpoba okha, and Egor local government area of Benin city and Oluku and Ekosodin villages in Ovia North East local government area and Eyaen village (coca cola area) in Uhumwonde local government area effective from 12pm on Sunday 16/6/2013 was ultra vires the powers of the said 1st respondent and therefore, unconstitutional, null and void and of no effect whatsoever.

B. Is hereby refused and dismissed.

C. Is hereby refused and dismissed

D. An order of this Court be and is hereby issued setting the verbal order of the 1st respondent made on 11/6/2013 banning the use of motor cycles from plying all the roads in oredo, ikpoba okha and egor local government areas of Benin City and Oluku and Ekosodin villages in Ovia North East local government area and Eyaen village (coca cola area) in Uhumwonde local effective from 12pm on Sunday 16/11/2013 for being unconstitutional, null and void and of no effect whatsoever

E. Is hereby refused and dismissed but in its stead the sum of N1,000 is hereby awarded as nominal charges in favour of the 1st appellant only as against the 1st respondents only

F. Is hereby refuse and dismissed

G. However, that part of the judgement of the Court below dismissing relief B, C and F as claimed by 1st and 2nd appellant as applicants against the 1st – 6th respondents as respondent’s in suit No FHC/B/CS/89/2013: Mr Charles Apiloko James & anor V. The governor of Edo state & ors is hereby affirmed

H. There shall be N300,000 in favour of the 1st Appellant only against the 1st Respondent only

Signed:
Sir Biobele Abraham Georgewill
Justice court of Appeal
Date: 25/5/2021

And ever since this judgement was delivered Edo state Government, the local government, the Nigeria Police Force and other sister agencies keep harassing members of the public found driving motorcycles in Benin city.

We cannot continue to live in a state where a court judgment can not be obeyed or adhered to.

The Africa charter and the 1999 constitution chapter 4 talks about FUNDAMENTAL RIGHTS of citizens clearly gives citizens rights to have property, movable and immovable properties of choice.

We also have met with the above institutions for peaceful dialogue to advice them on the need to obey the laws, which they all agreed to follow but most time they end up doing worst.

We are using this medium to inform all government agencies to obey the appeal court Judgement to avoid anarchy in the land, failure to do so will leave us with no other option than to shut down any office who tried to undermine the laws of the land and be resisted by Edo Civil Society Organisations (EDOCSO)

Our laws must be abide to and be respected at all time.

EDOCSO ENGAGES THE CHIEF JUDGE OVER THE USE OF TRUMPED UP CHARGES

The leadership of Edo Civil Society Organisations ably led by the Interim TEC Secretary, Leftist Grace Okike paid an advocacy visit to the chief judge of Edo state, Justice Daniel Okungbowa and other senior members of the bench over series of petitions received from the public to EDOCSO on the use of trumped-up charges by some officers of police in getting prison remands.

The meeting which was at the instance of EDOCSO was to draw the attention of the Judiciary and the chief judge in particular to the new trend of officers of the Nigeria police force, whereby they do use trumped-up charges to remand suspects in prisons, which has contributed largely to the congestion in various prisons in Edo state.

In recent times, the security agencies most especially the Nigeria police force has used the trumped-up charges to send innocent citizens to prisons, knowingly and unknowningly either to favour the highest bidder or to cover up their inability to do proper investigation on cases been reported to them.

As we all know the ACJA law of Edo state clearly states the manner and ways cases and suspects should be followed, most at times the laws are not usually followed, thereby leading to the violation of citizen’s rights.

The meeting was very interactive, Informative and ideals sharing, the chief judge promised to look into the issues raised and follow it up to the benefits of Edo State citizens and residents.

CURTIS OGBEBOR VS EDOCSO

COURT STRIKES OUT SUIT AIMED AT DESTABILIZING EDOCSO :

The court suit instituted by Curtis Ogbebor, Kelly Osunbor Omokaro and Charles Idehen against Omobude Agho, Osazee Edigin, Omoruyi Egharevba, Justice Itietie and Keshi St. Lawrence over non existent leadership tussle that was raised as a result of , insubordination, rebellion and unhealthy competition within the organisation has been struck out by the high court 6 sitting in Benin City today,Thursday 15th February 2024.

The presiding judge, Hon. Justice Peter Akhimie Akhihiero having examined the arguments raise by Barr U. L Osa – Uwagie, counsel to the defendants, the suit which had been running since 2022 after the first one was struck out in April 4th 2022 for lack of merit, was also struck out and dismissed due to the abandonment of the case in court by the applicants and their lawyers (which have been changed severally), pursuant to court order 30 rule 4 which talked about diligence persecution. A cost of one hundred thousand naira (N100,000) was awarded against them in favour of the defendants.

The social media space had been flooded with wrong news and blackmail of a purported plan by the immediate past executive of EDOCSO not to vacate office after expiration of tenure.

It must be stated that, EDOCSO as a coalition of several civil society groups and community based formations known as study centres is guided by rules which inordinate ambitions cannot infiltrate or derailed.

The sole thrusts of EDOCSO is for the pursuant of good governance, social justice and human rights and cannot be seen exhibiting the characteristics of a political party or politicians. It is a collaboration where your time and money is required for the overall good of the larger society hence the struggle for positions or titles aren’t what should be expected from any member.

The outcome of the court matter which is first in of its kind since the formation of EDOCSO has a lot of lessons to be learnt and the need to further prevent any future attempts to break the ranks. The suit was borne out of lack of adequate knowledge, over ambition and rebellious dispensation.

Let it been known to the general public that the present constituted leadership of Edo Civil Society Organisations, (EDOCSO) is ably led by the interim TEC chairman Leftist Austine Enabulele and any body or group of persons found parading themselves as the leaders, using any of our property without authorization or impersonating the network will be dealt with according to the laws

We want to reinterate that we hold no grudge against those that took the coalition to court but wish to rather advise them to retrace their steps and abide by the tenets of activism even if they decide not to belong to the coalition going forward.

We equally want to use this medium to extend the hands of friendship and comradeship to them should they decide to return to the coalition which has contributed immensely to their consciousness growth and development over the years.

In all, there is no victor, no vanquished.

PRESS STATEMENT

STATEMENT BY EDO CIVIL SOCIETY ORGANISATIONS (EDOCSO) ON ECONOMIC HARDSHIP AND UNBEARABLE HUNGER ON CITIZENS OF NIGERIA AND DEMAND TO END IT NOW BY THE FEDERAL GOVERNMENT OF NIGERIA. DELIVERED ON SATURDAY, 10TH FEBRUARY, 2024

We welcome all the ever steadfast comrades, citizens of our great nation and residents of Edo state, members of the press and distinguished ladies and gentlemen to this press conference.

The Edo Civil Society Organisations (EDOCSO) having observed and analysed carefully the cause of the unbearable hunger and economic hardship in Nigeria today, we discovered and concluded, that it’s as a result of the wickedness and inaptitude of the government of today who do not care about the welfare of the Nigeria citizens, and as such this is a breach of the contract entered by president Bola Ahmed Asiwaju Tunubu on the 29th day of may 2023 when he took the oat of office. And since that first day of taking over the leadership of Nigeria, Nigeria as a country has known no peace in terms of our daily living, starting from the increase in fuel price till date, continuous rising of dollar that has affected everything in Nigeria including farm produced that comes from our local farm to our markets today, this has make the saying that whatever goes up must surely come down an irony, considering dollar – naira exchange rate and suffering in Nigeria.

With dismay, pain and agony we have watched Nigerians groan in pains even when we try to assist as individual from our own personal struggles is still never enough, and this has led to the continuous rising of suicide being committed by Nigerians everyday because they can no longer bear the hunger and sufferings, woman are turning to widows and men widowers, children becoming fatherless or motherless all because, parents can no longer bear the pain of watching their children suffering, as a result of not being able to provide a meal for their children.

Is it the crime that has increased all over the 36 states including the FCT ? everyday we hear and experience kidnapping, arm robbery all over the country,
that even the common local Farmer, Petty trader and mechanics are now being kidnapped in Nigeria, in exchange for whatever the kidnappers can scoop for themselves from innocent citizens as ramsom. The federal government has suddenly become somewhat deaf and dumb that they have refused to act or do anything about it, the almighty Giant of Africa has suddenly become Handicapped

Today in our markets, we can not even buy products manufactured by us locally, even the foods we bring from our local farms, all because the prices of food and all other things are going up every blessed days, and the government supposedly have Agencies that controls market price, while these agencies watch in their slumber with their hands folded doing nothing to correct these abnormallies in the system and yet we say we have government in Nigeria?

Citizens get sick in Nigeria today, you can’t even afford money to buy common paracetamol, there are no health centers or government hospital to go to by citizen’s to be attended to, with little or no money. In some cases you go to the very limited hospitals and you are not well attended to by professionals because of it’s shortage, you can’t even get drugs from these few hospitals that are available and yet the wife of the president could donate 100,000 dollars to Sierra Leone to build hospital when we have needs for it here in Nigeria, how do you give what you don’t have? or is it the billions of naira that are been misappropriated or diverted into personal pockets by known and unknown government officials under this federal government everyday with impunity, and yet the perpetrators walk freely on the streets, money that could be use to better the Nigeria Society and citizens.

We also wants to state here that we are most disappointed in the National House Of Assemblies who has become a puppet in the hand of the Executive not knowing the power the constitution gave them to serve the people, but unfortunately we have slumbering representative who originally don’t know why they were sent to the National House Of Assemblies. But feel it’s their time to enrich themselves at the expense of Nigerians and we think to the extent of their uselessness, they should all go home, so Nigerians can now conveniently know they have a country without legislators.

Flowing from the above, it is clear of the general sufferings that Nigerians has been plunged into by the federal government since the day of taking over, due to the removal of fuel subsidy without proper plans on ground to ensure the welfare of Nigerians, and of course the further devalue of our Naira till date.

We say to the federal government led by president Asiwaju Bola Ahmed Tinubu, that he has failed in his responsibilities and agreement reached with Nigerians, in Section 14 subsection 2b and Section 16 subsection 1b of the 1999 Constitution of the federal republic of Nigeria. And as such have made the following demands

OUR DEMANDS

  1. That as a matter of Urgency put in place all machineries to ensure proper market price regulations to end the current Economic Hardship in Nigeria.
  2. That all Economic processes to give value to our currency be put in place.
  3. A proper Fair and citizens friendly policies be put in place to ensure economic stability in Nigeria.
  4. All security measures to end insecurity be activated immediately.
  5. If the Legislators are not ready to be Legislators and live up to their responsibilities and hold executive to perform according in with the constitution, they should shot down the Houses of assembly and go home, before we begin a call back on all of them.

CONCLUSION

We want to state clearly, that failure for the federal government to swing into emergency Action to end this HUNGER and Economic Suffering In Nigeria within the next two weeks, The President and the Vice should resign so we can elect a better leader, or we at Edo Civil Society Organisations (EDOCSO), will have no option than to mobilize other citizens all over the country on a Tunubu Shetima must go protest, and we shall ensure a change in the Leadership of Nigeria government to prove that indeed section 14 subsection 2a can be activated on any person elected into place of leadership.

We want to say thank you Nigerians for your patience and hard work so far, together we shall ensure a better tomorrow for Nigerians and not this present better yesterday that we are currently experiencing. Let’s not be discouraged by the show of ineptitude of our leaders, but focus on taking back our country from the hands of greedy politicians.

God Bless The Federal Republic Of Nigeria!

God Bless Edo Civil Society Organisations (EDOCSO)

God Bless Us All Nigerians.

Thank you.
